These terms govern your use of sebesta.co, including the free 3x Assessment. By using the site, you agree to them. If you don't agree, don't use the site. You're still welcome to just call or write.
What "3x" means, and doesn't
- "3x" (3x faster, 3x better, 3x more) is the internal standard we use to evaluate and select work. It describes how we decide what to take on, not a promise about what any engagement, tool, or strategy will return.
- We do not guarantee any outcome, result, savings, or return. Results depend on factors outside anyone's control, including your business, your team, your data, and how recommendations are implemented. Some initiatives will underperform the bar; that is why the bar exists.
- Figures on the site (failure rates, adoption statistics, the calculator) are illustrative or drawn from third-party reporting. The calculator's output is arithmetic on numbers you supply, under stated assumptions. It is a model, not a projection of your results.
The assessment
- The 3x Assessment is free and informational. It is generated by an artificial-intelligence model from the inputs you provide and may contain errors, omissions, or conclusions that don't fit your situation.
- It is not professional, legal, financial, accounting, or investment advice, and you should not rely on it as such. Consult qualified professionals before making business decisions.
- Requesting or receiving an assessment does not create a client, advisory, or fiduciary relationship with Sebesta & Co, and does not obligate either of us to anything. An engagement exists only when we both sign one.
Using the site
Use the site lawfully and as intended. Don't probe, scrape, overload, or abuse it, and don't submit content that is unlawful or that you lack rights to share. We may decline to generate an assessment or respond to any submission at our discretion.
Intellectual property
The site's content, design, and branding belong to Sebesta & Co. Your assessment is yours to keep and use internally. Nothing here transfers ownership of either side's materials.
Third-party services
Links and integrations (e.g., Google Calendar booking) go to services we don't control, each with its own terms. See our Privacy Policy for how information is handled and which providers are involved.
Disclaimer of warranties
The site and the assessment are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the site will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, Sebesta & Co will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data, arising from your use of the site or reliance on the assessment. Our total liability for any claim relating to the site or the free assessment is limited to one hundred dollars (US $100). Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in California.
Changes
We may update these terms; the effective date above will change when we do. Continued use after changes means you accept them.
